MONTAÑA FIGHTING SYSTEMS RELEASE & WAIVER

I hereby request permission from Montaqa MA, LLC (MMA) to use the gym, gym facilities, gym
equipment, and participate in classes at Montaña Fighting Systems (collectively, the “Gym”). In
consideration permission granted by MMA for me to use the Gym, and other good and valuable
consideration, the receipt and sufficiency of which is hereby acknowledged, I hereby acknowledge,
agree to the following:
1) I am in good health and have no disability, impairment, medical condition, illness or health related
issue which may prevent me from engaging in exercise or using the Gym or that poses a health risk to other users of the Gym. I assume full responsibility for my medical condition as it relates to engaging in exercise and using the Gym. I have adequate insurance (including, without limitation, health insurance) necessary to provide for and pay any and all medical costs that may directly or indirectly result from my use of the Gym.
2) I understand that my presence in the Gym, my participation in classes and activities, and my use of the Gym involves risk. I hereby knowingly and freely assume all risk and responsibility for any and all damage to property or bodily and/or personal injury, including paralysis and death, in connection with my use of the Gym.
3) I hereby release, discharge and agree not to sue (and relinquish my rights to sue) MMA,
officers, shareholders, agents (including managing agent) employees, attorneys, my training
partners and their respective successors and/or assigns from and with respect to any and all
liability, claims, demands, actions, suits, rights and/or causes of action of whatever kind or
nature, now or hereafter existing, whether known or unknown, present or future, foreseen or
unforeseen, whether caused by the negligence of MMA or an MMA Party or otherwise, that
may arise from my use of the Gym, including, without limitation, any damage to property or
bodily and/or personal injury in connection therewith. I hereby waive any protections afforded
by any statute or law in any jurisdiction whose purpose, substance and/or effect is to provide
that a general release shall not extend to claims, material or otherwise, which person giving the
release does not know or suspect to exist at the time of executing the release. This means, in part,
that I am hereby releasing any and all unknown future claims.
*** I acknowledge I have read and agree to the foregoing paragraph : 
4) MMA has advised me not to bring valuable personal property into the Gym. I assume full
responsibility for any loss of or damage to my personal property which may occur at the Gym. The
Montaña Fighting Systems shall not be liable for the loss, theft, or damage of any personal property
located anywhere in the Gym.
5) The Montaña Fighting Systems may repair, at my expense, all damage to the Gym caused by me,
and I agree to pay the Montaña Fighting Systems on demand any amounts so expended.
6) This Gym Release and Waiver covers any and all liability, claims and actions caused entirely,
or in part, by any and all acts or failures, including but not limited to, negligence or mistake of
MMA or third parties.
7) If any term or provision of this Gym Release and Waiver is held to be illegal, invalid or unenforceable, or the application thereof to any person or circumstance shall to any extent be illegal, invalid or unenforceable under present or future laws, then and in such event, it is the express intention of the parties that the remainder of this Gym Release and Waiver, or the application of such terms, clauses or provision other than to those as to which it is held illegal, invalid or unenforceable, shall not be affected thereby, and each term, clause or provision of this Gym Release and Waiver, and the application thereof, shall be legal, valid and enforceable to the fullest extent permitted by law. The provisions of this Gym Release and Waiver will continue in full force and effect even after the termination of the activities conducted by me at the Gym.
8) I have read and fully understand the terms of this Gym Release and Waiver, and that I may have
given up substantial rights by signing it, and sign it freely and voluntarily without any inducement. I
agree to abide by and be bound by the terms and conditions of this Gym Release and Waiver. I have had an opportunity to consult counsel regarding this Gym Release and Waiver.
9) For Participants of Minority Age (under 18) If the undersigned is under eighteen (18) years of age
(a “Minor”) then a parent of such Minor must accompany and supervise the Minor at all times during
such Minor’s use of the Gym, and the parents of the Minor must execute this Gym Release and
Waiver below, agreeing to be bound by, for and on behalf of the Minor, all terms and conditions
contained herein. This is to certify that I, as parent with legal responsibility for this Minor, do
consent and agree to such Minor’s execution of this Gym Release and Waiver, and I, for myself and
on behalf of such Minor, agree to be bound by all terms and conditions contained herein.
9.A Parental Responsibility Waiver and Agreement. As the parent or legal guardian of the
Minor, I understand that I am responsible for the Minor's safety, well-being, and supervision at all
times while the Minor is using the Gym. I will accompany and supervise the Minor at all times during
their use of the Gym and ensure compliance with all rules, policies, and instructions provided by the
Gym.
I, on behalf of myself and the Minor, hereby release, discharge, and agree not to sue MMA, its
officers, agents, employees, or other participants, for any claims or causes of action arising from
ordinary negligence. This release does not extend to gross negligence or intentional misconduct.
If any portion of this release as it pertains to the Minor is found to be invalid or unenforceable, it
is the intent of the parties that the remaining provisions, including those that relate to my own
obligations, remain in full force and effect. I understand that I may request more information about the risks involved in any activity and that I may decline to allow the Minor to participate in certain
activities if I believe they are too dangerous. I have had the opportunity to consult with legal counsel or ask questions regarding this release and waiver before signing. I understand that by signing this document, I may be giving up certain rights on behalf of the Minor.
I hereby consent to the use of photographs and/or videos of the Minor for promotional or
marketing purposes by Seguin Training Center, understanding that I may revoke this consent in
writing at any time.
*** I acknowledge I have read and agree to section 9 and 9.A : 

10) Photography/Video Release: Participants involved in any activities offered by Montaña Fighting
Systems may be photographed or videotaped during training. The undersigned hereby consents to the use of these photographs and/or videos without compensation, on the Montaña Fighting Systems website, social media, or in any editorial, promotional or advertising material produced and/or published by Montaña Fighting Systems .
